Injured at Work?

Help! I have been injured on the job in Georgia.  Now what?

1. Report your injury right away.  Under Georgia Workers' Compensation Law, you have 30 days to report an injury on the job. If you do not report your job--in writing--within 30 days, you may lose your right to Workers' Compensation Benefits, under O.C.G.A. 34-9-80.

2. Ask to be seen by a doctor. Even if you do not believe your injury to be serious in nature, it still is a good idea to be seen by a doctor, just in case.  Your employer is required to furnish a list of doctors, under O.C.G.A. 34-9-201.  You have the right to select the doctor from the panel.  If there is no posted panel, you may choose your own doctor.  Your employer/insurer is required to pay 100% of the medical bills related to your injury.  Your employer/insurer is also required to pay travel expenses to and from your medical care provider.

3. If your injury prevents you from working, obtain benefits. Workers' Compensation income benefits in Georgia are payable at the maximum rate of $500.00 per week.  No compensation will be paid for 21 days following notice, which is designed to allow the employer/insurer time to investigate the claim.

4. Contact a knowledgable attorney to discuss your rights.
